Finatech Terms & Conditions

Introduction

These Terms & Conditions ("Terms") govern the use of all aspects of Finatech Consulting LLC’s ("Finatech," "we," "us," or "our") website and services. By engaging in a service relationship with Finatech, you ("Client" or "you") agree to comply with these Terms as well as any other policies or guidelines referenced herein.

 

These Terms are effective as of November 11, 2024, and apply to any and all clients who utilize Finatech’s website, services, and related interactions.

 

Acceptance of Terms

By accessing and using Finatech Consulting LLC’s website or engaging with our services, you agree to be bound by these Terms & Conditions. If you do not agree to these Terms, you should discontinue use of our website and services.

 

We reserve the right to update or modify these Terms at any time. In the event of significant changes, we will notify you either via email or by posting a notice on our website. Your continued use of our website or services following such notice constitutes acceptance of the revised Terms.

 

Services Provided

Finatech Consulting LLC ("Finatech") offers a range of services designed to meet the financial and operational needs of small to medium-sized businesses. Our core services include:

  • Business entity creation

  • Tax registrations (including payroll, business, and sales & use tax)

  • QuickBooks setup and consultation

  • Payroll setup and integrations

  • Bookkeeping

  • Chart of accounts setup and maintenance

  • Bank reconciliations

  • Month-end close

  • Financial statements and financial statement analysis

  • Operational reports with KPIs

  • Budgeting and forecasting

  • Cash flow projections

  • Breakeven and what-if analysis

  • Corporate income tax filings

  • Sales and use tax filings

Finatech provides a selection of standardized service packages, which can be tailored to meet specific client needs. Changes or additions to a service plan may result in a quote adjustment.

 

Our services are limited to those listed above. Any additional services outside of this scope are not provided by Finatech.

 

User Responsibilities

As a client of Finatech Consulting LLC, you agree to fulfill the following responsibilities to ensure the effective delivery of our services:

 

Accurate Information: You are responsible for providing accurate, complete, and up-to-date information during onboarding, consultations, and any ongoing communications with Finatech.

 

Timely Data Sharing: To enable us to complete required tasks, you agree to share necessary data and information by the deadlines specified in Financial Cents. This includes responding to client tasks and meeting deadlines to facilitate timely reporting, filings, and other essential services.

 

Platform Security: If you use any online platforms provided or recommended by Finatech, such as Financial Cents, you are responsible for maintaining the confidentiality and security of your login credentials. Finatech is not liable for any unauthorized access resulting from your failure to protect your account information.

 

Payment Terms

Payment terms for Finatech Consulting LLC’s services vary based on the specific agreement and the start date of services for each client. Invoices will be issued according to the agreed-upon schedule for each client.

 

Payments are processed through Helcim, where clients may choose their preferred payment method. Clients are responsible for ensuring timely payment of invoices as outlined in their individual service agreements. Finatech provides flexibility regarding payment schedules, and clients are encouraged to communicate any payment-related concerns to maintain a seamless service relationship.

 

Privacy & Data Protection

Finatech Consulting LLC is committed to protecting the privacy and security of your personal information in compliance with applicable privacy laws. Our Privacy Policy explains how we collect, use, and protect your information. By agreeing to these Terms, you also agree to the practices outlined in our Privacy Policy.

Intellectual Property

All content on the Finatech Consulting LLC website, including but not limited to website text, branding, and newsletters, is the intellectual property of Finatech and is protected by copyright and other applicable intellectual property laws.

 

Clients and users are prohibited from copying, distributing, modifying, or otherwise using any Finatech content for any purpose outside of their service engagement with Finatech without express written permission.

Third-Party Services

In providing our services, Finatech Consulting LLC may utilize third-party platforms, including but not limited to Financial Cents and QuickBooks. While we carefully select third-party providers to support our operations, Finatech is not responsible for the practices, policies, or actions of these third-party providers.

 

Clients are responsible for maintaining their own accounts with third-party services, as applicable, and for adhering to the terms and conditions of those services.

 

Limitation of Liability

To the fullest extent permitted by law, Finatech Consulting LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services, including but not limited to loss of data, business interruptions, or financial losses.

 

While Finatech strives to provide accurate and reliable information in all reports and deliverables, we rely on the accuracy and completeness of data provided by clients. As such, Finatech disclaims any liability for inaccuracies that may result from incomplete or incorrect client information.

 

Indemnification

You agree to indemnify, defend, and hold harmless Finatech Consulting LLC, its officers, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including attorneys’ fees) arising from your actions, misuse of our services, or breach of these Terms. This includes indemnification against any third-party claims resulting from your breach of these Terms or any other wrongful conduct.

 

Termination of Service

Finatech Consulting LLC reserves the right to terminate services at any time if a client violates these Terms, including but not limited to failure to provide necessary information or non-payment.

 

If you wish to terminate services with Finatech, please contact us directly at info@finatechcpa.com. No advance notice period is required for client-initiated termination.

 

Upon termination, Finatech will follow its offboarding process, which includes either deleting your data from our platforms or transferring it to a new service provider, based on your preferences.

 

Changes to Terms & Conditions

Finatech Consulting LLC reserves the right to modify these Terms & Conditions at any time. Any changes will take effect immediately upon posting, and your continued use of our website or services constitutes acceptance of the updated Terms.

 

In the event of significant changes to these Terms, we will notify you via email or by posting a notice on our website.

 

Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall first be attempted to be resolved through mediation or arbitration before resorting to litigation, to the extent permitted by applicable law.
